Nurses Protest Ruling on On-Call Wage Violations Settlement

Madera, California — A Madera County Superior Court judge has approved a $400,000 settlement in a class action wage theft case against Valley Children’s Hospital. The settlement has drawn criticism from nurses who argue it ignores critical claims related to on-call wage violations.

The case, filed in 2022 by nurses Briana Westfall and Gloria Garcia, alleged that the hospital failed to:

  • Properly compensate overtime and all wages.
  • Provide required meals and rest breaks.
  • Reimburse work-related expenses.

The settlement covers employees who worked at the facility from June 2019 to April 2024.

Despite the hospital’s statement asserting it has always followed labor laws, over 40 staff members objected to the settlement in writing. Five nurses spoke out during the May 23 hearing, arguing that the deal inadequately addressed claims of sub-minimum wage pay for mandatory on-call hours.

A separate lawsuit filed in June 2024 by nurse Bonnie Ferreria specifically targets these on-call wage violations. Ferreria, who said she is owed nearly $28,000, criticized the earlier deal for limiting future legal recourse and releasing the hospital from further accountability.

Ferreria’s attorney confirmed plans to appeal the court’s approval.
