Oakland Sues Southwest Airlines for Violating Sick Leave Laws

Oakland, California — The City of Oakland has filed a lawsuit against Southwest Airlines, accusing the airline of denying workers their paid sick leave and violating a previous settlement agreement. The lawsuit, filed on Wednesday by City Attorney Barbara Parker, claims Southwest has failed to comply with Oakland and California sick leave laws.

According to the complaint, Southwest allegedly prevented some employees at Oakland International Airport from using their earned sick leave. The city also alleges that the airline retaliated against workers who attempted to use their sick leave and discouraged them from filing complaints.

Southwest, the largest airline at the Oakland airport, employs about 3,000 workers locally. Parker’s office argues that the airline’s actions have potentially impacted thousands of employees.

The lawsuit comes just days after Labor Day and cites a 2020 settlement agreement in which Southwest had committed to restoring canceled sick leave hours for certain employees. The city contends that the airline failed to fulfill this agreement.

Southwest denies the allegations, asserting it complies with local and state laws regarding sick leave. The airline has stated it is prepared to defend itself in court against these claims.

The city is seeking restitution, penalties, and enforcement of labor laws to protect workers’ rights.
