Wage Theft Lawsuit Filed Against Fresno Restaurant

Fresno, California — A recent wage theft lawsuit filed by the Fresno City Attorney’s Office alleges that workers at a now-closed local restaurant were denied wages, overtime, breaks, and gratuities. The case highlights how employee classification and incomplete time records can affect workers’ ability to receive the compensation they earned. The allegations remain subject to the court process.

Fresno Files Wage Theft Case Against Former Restaurant

On August 7, the Fresno City Attorney’s Office filed a civil complaint against Mirchi Massala, its owners, and a manager, alleging California labor violations affecting at least seven employees from December 2024 to March 2026.

According to the complaint, workers reported alleged violations only months after the restaurant opened at First Street and Shaw Avenue. Investigators allege that several employees were classified as salaried and exempt, even though their primary duties involved food preparation and cooking rather than management. 

As a result, their work hours were allegedly not properly documented, and they did not receive appropriate overtime or breaks. The wage theft lawsuit also alleges that employees were not paid in full and that gratuities were improperly withheld. 

What California Workers Should Know About Wage and Hour Rights

The allegations also illustrate that being paid a salary does not automatically make a California worker exempt from overtime. Exempt status generally depends on factors such as an employee’s actual job duties, discretion and independent judgment, and salary requirements.

California employees may have claims involving:

  • Unpaid overtime when a nonexempt employee works qualifying additional hours without proper compensation
  • Missed meal or rest periods when legally required breaks are not properly provided
  • Withheld tips or gratuities, which generally belong to the employees for whom they were left
  • Incorrect classification when job duties do not satisfy California’s requirements for an exemption

Fresno also operates a Wage Protection Program to address wage theft within the city.
