California’s Minimum Wage Rate Will Climb to $16.90 in 2026

California – California’s minimum wage rate is set to rise again, impacting thousands of workers and employers across the state. Starting January 1, 2026, the statewide minimum wage will rise to $16.90 per hour, representing another move in California’s ongoing efforts to adjust for inflation and living costs. This change will also impact salary thresholds for certain exempt employees, creating compliance considerations for businesses.

Details of the 2026 Minimum Wage Rate Increase

On August 1, 2025, California Director of Finance Joe Stephenshaw announced the official adjustment to the state’s minimum wage rate

The rate will increase from $16.50 to $16.90 per hour, showing a 2.49% increase based on the U.S. Consumer Price Index for Urban Wage Earners and Clerical Workers. California Labor Code §1182.12 mandates that the state’s finance director adjust the minimum wage yearly based on inflation data, within statutory limits.

The change follows a decade of steady increases, with the state’s rate more than doubling since 2014. In addition, certain municipalities, healthcare workers, and fast-food employees remain subject to higher local or industry-specific minimum wage rates.

Protecting Your Rights Under California Wage Laws

The upcoming change to California’s minimum wage rate may lead to potential wage-related claims if employers fail to comply. Common legal issues include:

  • Unpaid Wages: Employees paid below the updated minimum wage rate after January 1, 2026, may file claims.
  • Overtime Calculations: Minimum wage increases can affect overtime pay rates, and miscalculations may result in back pay claims.
  • Misclassification of Employees: Employers incorrectly classifying workers as exempt to avoid the new minimum salary threshold could face legal action.
  • Retaliation Claims: Workers who raise concerns about pay compliance are protected from retaliation under California labor laws.

An experienced employment lawyer can assist in evaluating wage disputes, filing claims with the California Labor Commissioner, or pursuing litigation to recover unpaid wages and penalties.
