San Jose, California — The U.S. Department of Labor has recovered more than $1.4 million in back wages for 2,620 employees of Cupertino Electric Inc. after a federal investigation uncovered violations related to unpaid overtime compensation.
A recent investigation by the Department’s Wage and Hour Division concluded that Cupertino Electric, a major electrical contractor headquartered in San Jose, failed to include non-discretionary bonuses in its overtime pay calculations. This omission resulted in workers receiving less than they were legally owed under the Fair Labor Standards Act (FLSA).
Key findings from the investigation include:
- $1,432,168 in back wages recovered
- 2,620 workers affected
- Violation: Exclusion of required bonuses when calculating overtime rates
Cupertino Electric, a subsidiary of Quanta Services, provides large-scale electrical systems to clients across multiple states, including California, Arizona, and Washington. The company’s missteps impacted workers in several of these regions.
Lilita Hom, Assistant District Director for the San Jose Wage and Hour Division, emphasized the Department of Labor’s commitment to ensuring employees receive the full amount of overtime pay they are legally entitled to.
